TERMS & CONDITIONS

The following is the terms of the agreement between "Realsauna Sporting Goods Company" and the buyer ("Buyer") of goods or services through the Company’s Web site (www.Realsaunasuit.com),(www.Realsauna.com). If you do not agree to these terms, you should not purchase anything from this web site, so please review these terms carefully.

1. Introduction: Buyer agrees to the terms and conditions outlined in this Online Contract ("Contract") with respect to the goods, services and information provided by or through the site. This Contract constitutes the entire and only agreement between the Company and Buyer, and supersedes any and all prior or contemporaneous agreements, representations, warranties, and understandings with respect to the goods, services and information provided by or through the site, and the subject matter of this Contract. Buyer agrees to review this Contract prior to purchasing anything and purchase of a good or service shall be deemed acceptance of this Contract.

2. Setup and Payment: Buyer represents and warrants that (i) the credit card or check information supplied is true, correct and complete and (ii) charges incurred by the Buyer will be honored by the Buyer’s credit card company or bank and (iii) Buyer shall pay charges incurred by Buyer at the amounts in effect at the time incurred, including all applicable taxes. Buyer shall be responsible for all charges incurred through use of Buyer’s Credit Card.

3. Use of Our Products: "Although many obesity experts believe that people who are less than 20% above their healthy weight (or whose BMI is 27 or above) should try to lose weight to reduce many health risk factors." Also people who want to tone and or tighten their muscles should use Realsauna SUITs. (Note: As with any exercise product or program, consult your Doctor prior to use. Should you experience any discomfort or dizziness during any exercise or activity while using Realsauna SUIT, STOP IMMEDIATELY and consult with a physician. You must be 18 years or older to purchase or use our products. Keep out of reach of children to avoid misuse of product, this product is made of a plastic material and could cause suffocation if misused. When using this product you must drink plenty of water, it is very important to keep your body hydrated throughout the day. PLEASE DO NOT USE THIS PRODUCT IN EXTREME HEAT OR TEMPERATURES!

4. Indemnification: Buyer agrees to indemnify, defend and hold Company and its affiliates, licensors and suppliers harmless from any liability, loss, claim and expense, including reasonable attorney’s fees, related to a Buyer’s violation of this Contract or use of the Site.

5. Trademarks and Copyrights: The content, organization, gathering, compilation, magnetic translation, digital conversion and other matters related to the Site are protected under applicable copyrights, trademarks, and other proprietary (including but not limited to intellectual property) rights, and, the copying, redistribution, use or publication by a Buyer of any such content or any part of the Site is prohibited.

6. Editing, Deleting, and Modification: Company reserves the right in its sole discretion to edit or delete any information or content appearing on the Site and to remove any goods and services for sale. Company may modify this Contract or prices, and may discontinue or revise any or all aspects of the Site in its sole discretion and without prior notice. Modification of this Contract will be deemed effective upon publication on the Site with respect to transactions occurring after said date.

7. Right to Refuse: Company reserves the right in its sole discretion to refuse service at any time. Sale of any goods or services is subject to availability.

8. Disclaimer: THE SERVICE CONTENT, GOODS AND SERVICES FROM OR THROUGH THE SERVICE ARE PROVIDED "AS-IS," "AS AVAILABLE." AND ALL WARRANTIES, EXPRESS OR IMPLIED ARE DISCLAIMED (INCLUDING BUT NOT LIMITED TO THE DISCLAIMER OF ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE). THE SOLE AND ENTIRE MAXIMUM LIABILITY OF THE COMPANY, FOR ANY REASON, AND BUYERS SOLE AND EXCLUSIVE REMEDY FOR ANY CAUSE WHATSOEVER, SHALL BE LIMITED TO THE AMOUNT PAID BY THE CUSTOMER FOR THE PARTICULAR ITEMS PURCHASED. COMPANY AND ANY OF ITS AFFILIATES, DEALERS OR SUPPLIERS ARE NOT LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES (INCLUDING DAMAGES FOR LOSS OF BUSINESS, LOSS OF PROFITS, LITIGATION, OR THE LIKE). WHETHER BASED ON BREACH OF CONTRACT, BREACH OF WARRANTY, TORT (INCLUDING NEGLIGENCE). PRODUCT LIABILITY OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE LIMITATIONS OF DAMAGES SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN COMPANY AND BUYER. THIS SITE AND GOODS AND SERVICES WOULD NOT BE PROVIDED WITHOUT SUCH LIMITATIONS. SOME STATE STATUTES MAY APPLY REGARDING LIMITATION OF LIABILITY.

9. Refund Policy: If a product purchased is defective from manufacturer. Buyer can return the product in its original condition within 14 days from the time of purchase, to the following address: PO BOX 901411, PALMDALE, CA. 93590. In such event, Company shall provide Buyer a credit for the returned product purchased from the Site (less shipping and handling charges incurred). If product has been worn or is not in original package with original tags and stickers attached and in new condition, no refund or credit will be granted. Note To Consumer: All products are checked for quality control before shipment to customers.

10. Return Policy: Refunds will be given for merchandise that is returned in its ORIGINAL CONDITION ONLY. Condition of returned merchandise will be determined by Realsauna Sporting Goods Quality Control Department. Merchandise that has been worn, stained, or torn due to negligence WILL NOT be accepted for refunds, but returned to buyer at buyer’s expense. Merchandise received and accepted in its original condition for a refund is subject to a 25% restocking fee, refunds will be given less shipping and handling charges and restocking fee. Items returned for even-exchange will not be subject to the restocking fee. PLEASE NOTE: ALL EXCHANGES ARE SUBJECT TO ADDITIONAL SHIPPING AND HANDLING CHARGES. You will be responsible for all fees and shipping costs to ship the item back to us. We will charge you an additional $13.00 to reship the exchanged item (Suit) back to you. All refused orders will be subject to a 25% restocking fee. Shipping charges are not refundable. In addition, refused orders may be subject to additional shipping charges to cover the cost of returning the products to Realsauna Warehouse. For all refunds please return all merchandise in new condition, including all promotional items, otherwise you will be charged for items not returned.

11. Product Guarantee: Realsauna Company does not imply or offer a lifetime guarantee on any of its products, nor do we guarantee how long the product will last during individual customer usage. The durability of REALSAUNA™ SAUNA SUIT will depend upon: (i) whether or not a customer ordered the appropriate size to accommodate their weight and size. (ii) How well a customer takes proper care of the product, as suggested on tags and or labels, (iii) whether a customer followed the care content instructions as provided with the product on tags and or labels. (iv)Realsauna will not replace, refund or be liable for any Realsauna product damaged due to negligence that is determined to be caused by the customer.

Use of Information: Company reserves the right, and Buyer authorizes Company, to the use and assignment of all information regarding Buyers use of the Site and all information provided by Buyer, subject to applicable law.
Miscellaneous: This Contract shall be treated as though it were executed and performed in the City of Palmdale, Los Angeles County and shall be governed by and construed in accordance with the laws of the United States of America and of the State of CALIFORNIA (without regard to conflict of law principles). Any cause of action of Buyer with respect to the Site must be instituted within six months after any purchase or be forever waived and barred. All actions shall be subject to the limitations set forth in Section 8 (Disclaimer). The language in this Contract shall be interpreted as to its fair meaning and not strictly for or against any party. All legal proceedings arising out of or in connection with this Contract shall be brought solely in LOS ANGELES COUNTY, CALIFORNIA and Buyer expressly submits to the jurisdiction of said courts and Buyer consents to extra-territorial service of process. Should any part of this Contract be held invalid or unenforceable, that portion shall be construed consistent with applicable law as nearly as possible to reflect the original intentions of the parties and the remaining portions shall remain in full force and effect. To the extent that anything in or associated with the Site or the Company is in conflict or inconsistent with this Contract, this Contract shall take precedence. Failure of Company to enforce any provision of this Contract shall not be deemed a waiver of such provision nor of the right to enforce such provision.

IMPORTANT PRODUCT LIABILITY WARNING NOTICE!!

As with any exercise product or program, CONSULT YOUR PHYSICIAN PRIOR TO USE!!!! Should you experience any discomfort associated with any type of allergic reaction
or dizziness during exercise or activity while using REALSAUNA SUIT OR SWEAT Creme, STOP immediately, REMOVE THE SUIT and consult with a physician or seek emergency medical assistance! Do NOT abuse this product. DO NOT USE THIS PRODUCT WITHOUT CONSULTING WITH YOUR PHYSICIAN PRIOR TO USE! REALSAUNA PRODUCTS ARE NOT RECOMMENDED FOR CHILDREN OR FOR ANY PERSON UNDER 18 YEARS OF AGE! USE CAUTION WHEN USING THIS PRODUCT, DEHYDRATION CAN BE DANGEROUS IF THE BODY IS NOT CONSTANTLY RE-HYDRATED DURING WORKOUT. DO NOT USE THIS PRODUCT IN EXTREMELY HOT TEMPERATURES OR IN A SAUNA. Although this product has been proven effective in aiding with rapid weight loss, Realsauna Company does not guarantee any one person’s results. Results are based solely on each individual and how much of an effort of physical exercise is put forth. Realsauna Company is not responsible for the misuse of this product and relinquishes all liability because of misuses that may result in personal injury or death! The use of this product is a personal choice, and should be used with caution and at your own risk. If you have any type of skin sensitivity to various plastics, vinyl, latex or other materials, this product is not recommended for you, and could cause an allergic reaction. DO NOT USE THIS PRODUCT WITHOUT CONSULTING WITH YOUR PHYSICIAN OR DERMATOLOGIST FIRST. Realsauna is not liable for any allergic reaction you may experience and the use of this product is a personal choice and is the consumers sole responsibility. Once this product has been worn or used, it cannot be returned for a refund for any reason due to the personal nature of its use. Although this product has not been found to cause any adverse effects or injury, one’s own individual abuse or type of use could alter these findings, therefore Realsauna Company warns against misuse, and again relinquishes all liability.
